Welcome to ECOTREK. These Terms of Service ("Terms") govern your use of our website and the purchase of products ("Products") from ECOTREK.
Please read these Terms carefully before placing an order. By accessing our website or purchasing from us, you agree to these Terms, together with our Privacy Policy, Shipping & Delivery Policy, Returns, Refunds & Warranty Policy, and other applicable policies published on our website.
Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under New Zealand law, including the Consumer Guarantees Act 1993 (CGA) and the Fair Trading Act 1986 (FTA).
1. Purchasing from ECOTREK
By placing an order with ECOTREK, you confirm that:
You are legally capable of entering into a binding contract.
You are at least 18 years old, or have the consent of a parent or legal guardian to make the purchase.
The information you provide is accurate, complete and up to date.
You are authorised to use the selected payment method.
Payment Methods
ECOTREK accepts payments through Shopify Payments and Afterpay for eligible online purchases. Available payment methods will be displayed at checkout.
PayPal is also available for eligible in-store payments.
Payments are processed securely through the relevant payment service providers. ECOTREK does not store customers' full payment card details.
Payment options may vary depending on the purchase method, customer eligibility and payment provider availability.
We may contact you using the email address or other contact details provided with your order where necessary to process your purchase, arrange delivery or resolve an order-related issue.
Order Acceptance
An order confirmation email acknowledges that we have received your order. It does not necessarily mean that the order has been accepted.
We may review an order before acceptance, including checking stock availability, payment authorisation and the accuracy of the order information.
If we cannot accept an order, we will notify you and arrange a refund of any payment collected for the cancelled items.
2. Coupons & Store Credit
Coupons
ECOTREK promotional codes may be valid online, in store or through specified sales channels, depending on the promotion.
Coupons must be used within their stated validity period and in accordance with any advertised conditions.
Unless otherwise stated, promotional coupons cannot be exchanged for cash or combined with other offers.
We may refuse the use of a coupon where there is reasonable evidence of fraud, misuse or a breach of its published conditions.
Store Credit
Store credit may be issued as part of a promotion, goodwill arrangement or agreed customer resolution.
Promotional store credit is generally not redeemable for cash, unless required by law or expressly agreed.
Items purchased using promotional store credit remain subject to our published voluntary change-of-mind returns policy.
Where a refund is required under applicable consumer law, the original payment method or use of store credit does not remove the customer's statutory rights.
Any additional conditions applying to a particular coupon or store credit will be disclosed when it is issued.
3. Pricing and Errors
Unless otherwise stated, prices displayed on our New Zealand website are in New Zealand Dollars (NZD).
Applicable taxes, delivery charges and other disclosed fees will be shown during checkout or otherwise communicated before the customer agrees to pay them.
Prices and promotions may change without prior notice, but changes will not automatically alter orders already accepted.
Online and in-store prices may differ where this is clearly disclosed.
We take reasonable care to ensure that product prices and information are accurate.
If an obvious pricing or listing error is identified before an order has been accepted, we may contact the customer to confirm the correct details or decline the order and refund any payment received.
Where an error is discovered after an order has been accepted, the matter will be handled in accordance with the applicable contract and New Zealand law.
Nothing in this section permits misleading pricing practices or removes a customer's statutory rights.
4. Product Information & Usage Disclaimer
Product Information
ECOTREK aims to provide accurate product descriptions, images, specifications and other information.
Product colours may appear slightly different due to lighting, photography and individual screen settings. Minor variations may also occur between production batches or materials.
Unless expressly stated otherwise, product dimensions and weights are approximate and may vary slightly due to manual measurement or manufacturing tolerances.
These allowances do not permit material differences from a product's description or remove any guarantees relating to acceptable quality, fitness for purpose or correspondence with description.
Outdoor Equipment Use
Products such as tents, sleeping bags, camping furniture, shelters and other outdoor equipment must be used in accordance with their intended purpose and any supplied instructions.
Customers should read and follow applicable safety and assembly instructions.
Customers should check the suitability of the product for the intended activity and environment.
Customers should use appropriate fixing, securing and maintenance methods.
Customers should inspect equipment before use and discontinue use if a safety concern arises.
Assembly & Setup
Incorrect assembly, installation or use may create safety risks or cause damage.
Damage caused solely by misuse, improper installation or failure to follow reasonable instructions may fall outside our additional commercial warranty.
However, each claim will be assessed on its circumstances and in accordance with applicable consumer law.
Weather & Environmental Conditions
Outdoor conditions can change rapidly. Strong winds, heavy rain, flooding, fire and other environmental hazards may affect the safety and performance of outdoor equipment.
Customers should consider weather forecasts, local warnings, ground conditions and product-specific limitations before and during use.
Not all outdoor products are designed for extreme weather. Unless a particular product is expressly rated for specific conditions, no such rating should be assumed.
For further information, please refer to the outdoor safety guidance in our Returns, Refunds & Warranty Policy.
We do not exclude liability for any product defect or failure to meet a statutory consumer guarantee merely because the product was used outdoors or exposed to weather.
5. Stock Availability & Multiple Shipments
All products are subject to availability.
Although we aim to maintain accurate stock information, occasional discrepancies may occur.
If an ordered product becomes unavailable, we will contact the customer to discuss an appropriate alternative, revised fulfilment arrangement or refund.
Orders containing products from different warehouses or fulfilment partners may be delivered in separate shipments.
Any additional shipping charge not previously agreed to by the customer will be disclosed and must be accepted before it is charged.
We will not substitute a materially different product without the customer's agreement.
6. Cancelling Orders
Customers who wish to cancel an order should contact us as soon as possible at support@ecotrek.co.nz.
We will make reasonable efforts to accommodate cancellation requests before an order has been dispatched or otherwise committed to fulfilment.
Once an order has been dispatched, any voluntary cancellation or return will be handled in accordance with our Returns, Refunds & Warranty Policy.
ECOTREK may decline or cancel an order where there are reasonable grounds, including suspected fraudulent or unauthorised transactions, unavailable stock, an obvious error identified before order acceptance, misuse of promotional offers, or an inability to complete the transaction or fulfil the order lawfully.
If ECOTREK cancels an order, we will refund any payment received for the cancelled items.
Any other rights or remedies arising under applicable law remain unaffected.
7. Delivery & Pickup
Delivery options, charges, estimated timeframes and applicable conditions are explained in our Shipping & Delivery Policy.
Estimated delivery dates are provided in good faith and may be affected by courier operations, destination, weather and other circumstances.
Where a delivery timeframe has been agreed, we will take reasonable steps to meet it. If no timeframe has been agreed, delivery must occur within a reasonable time as required by applicable law.
If an order is delayed, lost or delivered incorrectly, please contact us so we can investigate and arrange an appropriate resolution.
Nothing in these Terms excludes any applicable statutory guarantee relating to delivery.
For collection orders, customers should refer to our Pickup Policy and follow the collection instructions provided with their order.
8. Reviews & User-Generated Content
Customers may submit product reviews, photographs, comments or other content ("User Content") through our website or associated channels.
By submitting User Content, you confirm that you have the right to share the material, that the content is accurate to the best of your knowledge, and that it does not unlawfully infringe another person's rights or contain unlawful, abusive or misleading material.
You grant ECOTREK a non-exclusive, royalty-free licence to display, reproduce and use the submitted content in connection with our website, products and marketing, subject to applicable law and any permissions or restrictions communicated when the content is submitted.
We may moderate or remove content where reasonably necessary for legal compliance, security, relevance or the prevention of abuse.
We will not knowingly misrepresent customer reviews or publish misleading testimonials.
9. Promotions & Discounts
Promotions apply only during their advertised periods and while any stated conditions are met.
Promotional offers cannot be combined unless expressly permitted.
Discounts apply only to eligible products or orders.
We may amend or withdraw future promotional offers, subject to any commitments already made and applicable law.
Where a promotional purchase is voluntarily returned and a refund is approved, the refund will generally reflect the amount actually paid for the returned product, subject to the applicable promotion conditions.
Any refund required under consumer law will be handled in accordance with the customer's statutory rights.
10. Warranty & Returns
Please refer to our Returns, Refunds & Warranty Policy for detailed information about our additional 12-month manufacturing defects warranty, voluntary change-of-mind returns within seven calendar days of receiving eligible products, return eligibility, faulty or damaged products, refunds, replacements, repairs, return shipping arrangements and outdoor equipment safety guidance.
Our additional commercial warranty operates alongside, and does not replace or limit, the rights provided by the Consumer Guarantees Act 1993.
Unauthorised Modifications
Unauthorised alterations, repairs or modifications may affect eligibility under our additional commercial warranty where they cause or contribute to the relevant damage or fault.
Such modifications do not automatically remove all rights under applicable consumer law.
Claims will be assessed according to the nature and cause of the problem.
11. Legal Compliance & Consumer Rights
ECOTREK operates in accordance with applicable New Zealand law, including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.
Where the CGA applies, products must meet the guarantees required by law, including acceptable quality, fitness for purpose and correspondence with description.
Depending on the circumstances, customers may be entitled to a repair, replacement, refund or other remedy.
These statutory rights apply independently of any additional warranty or voluntary return policy provided by ECOTREK.
Business Purchases
The application of the CGA to a particular purchase depends on the circumstances and the legislation.
Purchasing a product for business use does not, by itself, mean that the CGA is automatically excluded in every situation.
Any agreement to contract out of the CGA must satisfy the applicable legal requirements, including those relating to written agreements between parties in trade and fairness and reasonableness.
These Terms do not, by themselves, create a blanket exclusion of the CGA for business customers.
12. Website Compatibility & Intellectual Property
Our website is intended to operate with commonly used modern browsers, including Chrome, Safari, Firefox and Edge.
We cannot guarantee uninterrupted compatibility with every device, browser version or third-party extension.
Unless otherwise indicated, the website's original text, design, branding and other proprietary content belong to ECOTREK or are used with permission from the relevant rights holders.
You may access and use our website for lawful personal shopping and information purposes.
You must not reproduce, distribute or commercially exploit protected website content without the appropriate permission, except where permitted by law.
13. Third-Party Links & Tools
Our website may contain links to external websites, payment providers, delivery services or other third-party platforms.
These services may operate under their own terms and privacy policies.
ECOTREK does not control all third-party websites and is not responsible for their independent content or practices.
However, the involvement of a third-party provider does not automatically remove any responsibility ECOTREK has to customers under applicable law.
We encourage customers to review the relevant third-party terms before using external services.
14. Events Beyond Our Reasonable Control
Events beyond our reasonable control may affect our ability to fulfil certain obligations.
Such events may include natural disasters, severe weather, significant transport disruptions, strikes, industrial action, public health emergencies, government restrictions, and major supplier or infrastructure disruptions.
Where such circumstances affect an order, we will take reasonable steps to inform the customer and seek an appropriate solution.
Any rights relating to delayed delivery, cancellation, refunds or other remedies under applicable law remain unaffected.
15. Account Suspension & Termination
We may suspend, restrict or terminate access to customer accounts where reasonably necessary, including in cases involving fraud or suspected unauthorised activity, security risks, serious misuse of our website, repeated or material breaches of these Terms, or legal and regulatory requirements.
Where appropriate, we may provide notice or an opportunity to resolve the issue.
Account suspension or termination does not remove any outstanding legal obligations or statutory consumer rights relating to purchases already made.
16. Children & Privacy
Our website and products are primarily intended for adult customers.
Customers under 18 should obtain the consent of a parent or legal guardian before making purchases.
We do not knowingly seek to collect personal information from children where such collection would be unlawful or inappropriate.
Personal information is handled in accordance with our Privacy Policy and applicable New Zealand privacy law.
If you have concerns about personal information provided by a minor, please contact us.
17. Accessibility
ECOTREK aims to make its website accessible and usable for customers.
If you experience difficulties accessing information, navigating the website or completing an order, please contact support@ecotrek.co.nz.
We will make reasonable efforts to assist.
18. Changes to These Terms
ECOTREK may update these Terms to reflect changes in our operations, services, legal requirements or website features.
The updated Terms will be published on our website with a revised last-updated date.
Changes will generally apply prospectively and will not retrospectively remove rights or alter obligations under an order already accepted, unless permitted by law or agreed with the customer.
Continued use of the website after publication of updated Terms may indicate acceptance of the revised website-use conditions, subject to applicable law.
19. Severability
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or limited to the extent permitted by law.
The remaining provisions will continue to apply to the extent they remain lawful and enforceable.
20. Website Usage & Limitation of Liability
We aim to keep the information on our website accurate, current and accessible.
However, temporary interruptions, technical issues or unintentional errors may occur.
To the extent permitted by law, ECOTREK is not responsible for losses arising solely from circumstances beyond our reasonable control or from unlawful or improper use of the website.
Nothing in these Terms excludes, restricts or modifies liability or remedies that cannot lawfully be excluded, including rights under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or other applicable legislation.
In particular, these Terms do not exclude statutory remedies for faulty products, misleading representations or other failures to meet applicable consumer guarantees.
21. Customer Responsibility & Indemnity
Customers must use our website lawfully and must not engage in fraudulent activity, interfere with website security or knowingly infringe the rights of others.
To the extent permitted by law, a customer may be responsible for reasonably foreseeable losses directly caused by their unlawful conduct or material breach of these Terms.
Nothing in this section requires a customer to indemnify ECOTREK for ECOTREK's own unlawful conduct, negligence or breach of statutory obligations, or otherwise limits rights that cannot lawfully be excluded.
22. Governing Law
These Terms are governed by the laws of New Zealand.
Any dispute relating to these Terms or purchases from ECOTREK will be subject to applicable New Zealand law and the jurisdiction of the relevant courts or tribunals, subject to any mandatory legal requirements.
Customers outside New Zealand may also have rights under laws applicable to their location.
23. ECOTREK Affiliation Disclaimer
ECOTREK is an independent retailer.
Unless expressly stated, ECOTREK is not affiliated with, endorsed by or sponsored by any third-party brand or manufacturer whose products may be offered for sale.
Third-party brand names, trademarks and product identifiers remain the property of their respective owners.
References to third-party brands are used for legitimate product identification or descriptive purposes and do not imply an official partnership.
